These terms apply to your use of this website and to quotes and bookings with BSY Transport, a trading name of BSY Pty Ltd (ABN 38 609 676 066) ("we", "us", "our"). By using this website, accepting a quote or booking a job, you ("you", "the customer") agree to these terms. If a written quote or invoice includes different terms, those terms apply to that job.
1.1 The information on this website is general. We try to keep it accurate and up to date, but services, capacities, areas and timeframes can change, and the website isn't a quote or an offer.
1.2 You must not misuse this website, including by trying to interfere with how it works or sending false or misleading enquiries.
1.3 The content, logos and images on this website belong to us or our licensors. You may not copy them for commercial use without our written permission.
1.4 This website may link to other websites. We're not responsible for their content.
2.1 Quotes are based on the information you give us, including the item, its size and weight, the pickup and delivery addresses, and site access. Please be accurate and complete.
2.2 A quote is valid for the period stated on it. If no period is stated, it's valid for 14 days.
2.3 If the job turns out different from what you described (for example, the item is heavier or larger, a vehicle doesn't run, access is harder, or there's extra waiting time or an extra trip), we may change the price, reschedule or decline the job. We'll talk to you before doing any extra work where we reasonably can.
2.4 Prices are in Australian dollars and include GST unless the quote says otherwise.
3.1 A booking is confirmed when we confirm it with you by phone, email or message.
3.2 Pickup and delivery dates and times are estimates. We'll do our best to meet them and will keep you updated, but weather, road closures, breakdowns, traffic, permits and other things outside our control can cause delays.
3.3 If you need to change or cancel a booking, please tell us as early as possible. If you cancel or change a booking after the truck has been dispatched, or if the truck can't load or unload because the item, site or people aren't ready, we may charge for the time and travel involved.
You must:
4.1 make sure you own the item or have the owner's permission for us to move it;
4.2 tell us about anything that affects safe loading, transport or unloading, including weight, dimensions, attachments, damage, leaks, and whether a vehicle or machine runs;
4.3 provide safe, clear and legal access at both ends, with enough room for the truck to get in, position, load or unload, and leave, on ground that can take its weight;
4.4 arrange any permits or permissions needed for the pickup or delivery site (for example, council or body corporate approval);
4.5 make sure someone is available at both ends to hand over or receive the item, unless we've agreed otherwise in writing;
4.6 remove loose items and personal belongings from vehicles and machines, and secure or remove the contents of containers unless we've agreed otherwise;
4.7 not ask us to carry dangerous goods, illegal items or anything we haven't agreed to carry.
5.1 Our drivers may refuse to load or unload if they reasonably believe it's unsafe or the job is different from what was quoted.
5.2 We restrain loads to suit the item and in line with the law. We may decide the safest loading position and method.
5.3 Please inspect the item at pickup and delivery with our driver, and note any existing or new damage at the time.
6.1 Payment is due as stated on your quote or invoice.
6.2 If payment is overdue, we may hold off on further work and recover reasonable collection costs.
7.1 We're fully insured. If something is damaged while in our care, please tell us as soon as possible, ideally at delivery and no later than 7 days afterwards, with photos and details.
7.2 We're not responsible for loss or damage caused by: existing wear, damage or defects; inaccurate information you gave us; the condition of the site or access you provided; items or contents you didn't tell us about; or events outside our reasonable control.
8.1 Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that they'll be provided with due care and skill. Nothing in these terms excludes, restricts or changes those rights.
8.2 To the extent the law allows, and where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to meet a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again.
9.1 To the extent the law allows, we're not liable for indirect or consequential loss, including loss of profit, income or use, or delay costs.
9.2 To the extent the law allows, our total liability for any job is limited to the amount of the relevant claim our insurer accepts, or otherwise the price paid for that job.
We handle personal information in line with our Privacy Policy.
11.1 These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of Queensland.
11.2 If any part of these terms is invalid or unenforceable, the rest still applies.
11.3 We may update these terms from time to time. The version on this website when you book applies to that booking.
